As a\u00e7\u00f5es judiciais com risco de perda classificado como prov\u00e1vel pela Uni\u00e3o cresceram quase oito vezes desde 2014 e somam R$ 634 bilh\u00f5es neste ano. O documento avalia o risco de a Uni\u00e3o ter que gastar mais que o previsto no Or\u00e7amento por conta de demandas judiciais ou mesmo outros fatores.<\/p>\n\n\n\n<p>O volume estimado de perda prov\u00e1vel \u00e9 bem maior que os R$ 403 bilh\u00f5es que o governo considera prov\u00e1vel receber dos devedores inclu\u00eddos na d\u00edvida ativa da Uni\u00e3o.<\/p>\n\n\n\n<p>O principal motivo para a disparada nos riscos da Uni\u00e3o foi a&nbsp;<a href=\"https:\/\/exame.abril.com.br\/economia\/stf-decide-que-icms-nao-incide-no-calculo-do-pis-e-da-cofins\/\">decis\u00e3o do Supremo Tribunal Federal (STF) que tirou o ICMS da base da c\u00e1lculo do PIS e da Cofins.<\/a>&nbsp;A perda, s\u00f3 nesse caso, est\u00e1 estimada em R$ 246 bilh\u00f5es. O Supremo ainda vai definir a aplica\u00e7\u00e3o dessa decis\u00e3o. Ser\u00e1 preciso definir, por exemplo, se o governo precisar\u00e1 devolver dinheiro para quem pagou imposto a mais.<\/p>\n\n\n\n<p>De 2014 at\u00e9 2019, os processos contra a Uni\u00e3o cresceram no total 290%, passando de R$ 559 bilh\u00f5es para R$ 2,1 trilh\u00f5es. Mas isso tamb\u00e9m tem crescido.<\/p>\n\n\n\n<p>Enquanto em 2014 os pagamentos referentes as a\u00e7\u00f5es judiciais ficaram em R$ 19,8 bilh\u00f5es, em 2018 chegaram a R$ 38,2 bilh\u00f5es (crescimento de 93%), representando 2,8% de todas as despesas do governo federal. Em 2019, apenas at\u00e9 junho, atingiram R$ 31,6 bilh\u00f5es, podendo fechar o exerc\u00edcio em R$ 42 bilh\u00f5es.
