{"id":5048,"date":"2019-12-23T12:35:07","date_gmt":"2019-12-23T15:35:07","guid":{"rendered":"https:\/\/justicapotiguar.com.br\/?p=5048"},"modified":"2019-12-23T12:21:48","modified_gmt":"2019-12-23T15:21:48","slug":"sancionada-lei-que-submete-honorarios-de-advogados-publicos-ao-teto","status":"publish","type":"post","link":"https:\/\/justicapotiguar.com.br\/index.php\/2019\/12\/23\/sancionada-lei-que-submete-honorarios-de-advogados-publicos-ao-teto\/","title":{"rendered":"Sancionada lei que submete honor\u00e1rios de advogados p\u00fablicos ao teto"},"content":{"rendered":"\n<p>Foi&nbsp;<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2019\/lei\/L13957.htm\" target=\"_blank\" rel=\"noreferrer noopener\">publicada<\/a>&nbsp;nesta quinta-feira (19\/12)&nbsp;lei que&nbsp;submete o pagamento dos honor\u00e1rios de sucumb\u00eancia de advogados p\u00fablicos ao teto constitucional.&nbsp;A Lei 13.957\/2019 estabelece as diretrizes or\u00e7ament\u00e1rias para 2020.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img loading=\"lazy\" src=\"https:\/\/www.conjur.com.br\/img\/b\/dinheiro3.jpeg\" alt=\"\" width=\"472\" height=\"354\"\/><figcaption><sup>Reprodu\u00e7\u00e3o<\/sup><\/figcaption><\/figure><\/div>\n\n\n\n<p>Conforme o texto, sancionado pelo presidente Jair Bolsonaro, &#8220;para fins de incid\u00eancia do limite de que trata o inciso XI do art. 37 da Constitui\u00e7\u00e3o, ser\u00e3o considerados os pagamentos efetuados a t\u00edtulo de honor\u00e1rios advocat\u00edcios de sucumb\u00eancia\u201d.&nbsp;<\/p>\n\n\n\n<p><strong>No Supremo<\/strong><br>Em dezembro de 2018, a mat\u00e9ria foi questionada no Supremo Tribunal Federal pela Procuradoria-Geral da Rep\u00fablica.&nbsp;O relator da ADI 6.053 \u00e9 o ministro Marco Aur\u00e9lio.<\/p>\n\n\n\n<p>Sob o comando de&nbsp;Raquel Dodge, a PGR defendeu que a remunera\u00e7\u00e3o de servidores federais s\u00f3 pode ser alterada por lei espec\u00edfica, de iniciativa do presidente da Rep\u00fablica.
