que a recusa do condutor de ve\u00edculo automotivo em realizar o teste do baf\u00f4metro, por si s\u00f3, configura infra\u00e7\u00e3o de tr\u00e2nsito.<\/p>\n\n\n\n<figure ilustrativa<\/figcaption><\/figure>\n\n\n\n<p>Para fixar a tese, o colegiado considerou o artigo 165-A do&nbsp;<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9503.htm\">CTB<\/a>, que determina ser infra\u00e7\u00e3o grav\u00edssima a recusa ao teste, per\u00edcia ou outro procedimento que permite verificar a influ\u00eancia de \u00e1lcool ou outra subst\u00e2ncia psicoativa&nbsp;no condutor do ve\u00edculo.<\/p>\n\n\n\n<p>De acordo com o relator, desembargador&nbsp;Asiel Henrique de Sousa, o C\u00f3digo de Tr\u00e2nsito contempla duas infra\u00e7\u00f5es distintas, uma para quem se recusa a realizar o teste e outra para quem est\u00e1 comprovadamente embriagado e se op\u00f5e ao teste.<\/p>\n\n\n\n<p>Conforme explicou o relator, o condutor que dirige comprovadamente embriagado e tenha ou n\u00e3o se recusado ao teste, responder\u00e1, al\u00e9m de infra\u00e7\u00f5es administrativas, a infra\u00e7\u00f5es penais.<\/p><div o magistrado, apesar de constitu\u00edrem infra\u00e7\u00f5es administrativas distintas, ambas t\u00eam a mesma puni\u00e7\u00e3o: multa e suspens\u00e3o do direito de dirigir por 12 meses e recolhimento do documento de habilita\u00e7\u00e3o e reten\u00e7\u00e3o do ve\u00edculo.<\/p>\n\n\n\n<p>Diante da diferencia\u00e7\u00e3o, a turma fixou, por unanimidade, a seguinte tese:\u00a0<em>&#8220;A recusa do condutor de ve\u00edculo, abordado na dire\u00e7\u00e3o de ve\u00edculo em via p\u00fablica e\/ou que tenha se envolvido em acidente de tr\u00e2nsito, em realizar o teste do etil\u00f4metro, por si s\u00f3, configura a infra\u00e7\u00e3o de tr\u00e2nsito prevista no art.165-A do C\u00f3digo de Tr\u00e2nsito Brasileiro, independentemente da elabora\u00e7\u00e3o de
