At\u00e9 o momento, s\u00e3o oito votos contr\u00e1rios \u00e0 tese \u2014 Edson Fachin, Alexandre de Moraes, Cristiano Zanin, Lu\u00eds Roberto Barroso, Dias Toffoli, Luiz Fux, C\u00e1rmen L\u00facia e Gilmar Mendes.<\/p>\n\n\n\n<p>Do outro lado, s\u00e3o favor\u00e1veis \u00e0 tese do marco os ministros Nunes Marques e Andr\u00e9 Mendon\u00e7a. O pronunciamento do voto de Fux causou grande comemora\u00e7\u00e3o do lado de fora do Supremo, onde ind\u00edgenas de diferentes etnias acompanham o julgamento. Esta \u00e9 a d\u00e9cima primeira sess\u00e3o de julgamento sobre o marco temporal que a Corte realiza.<\/p>\n\n\n\n<p>Fux e C\u00e1rmen seguiram a posi\u00e7\u00e3o do relator, ministro Edson Fachin. Tamb\u00e9m contr\u00e1rios ao marco temporal, mas com diverg\u00eancias com rela\u00e7\u00e3o a algumas outras condicionantes, foram os ministros Alexandre de Moraes, Cristiano Zanin e Dias Toffoli.
