Os desembargadores que comp\u00f5em o colegiado voltaram a destacar posi\u00e7\u00e3o do STF, o qual, no julgamento de uma quest\u00e3o de ordem na a\u00e7\u00e3o penal 937 firmou a tese de que o \u201cforo por prerrogativa de fun\u00e7\u00e3o\u201d ou \u2018foro privilegiado, aplica-se apenas aos crimes cometidos durante o exerc\u00edcio do cargo e relacionados \u00e0s fun\u00e7\u00f5es desempenhadas.
