Em tais circunst\u00e2ncias, o inadimplemento do devedor fiduciante enseja a aplica\u00e7\u00e3o da regra prevista nos&nbsp;arts.&nbsp;26 e 27 da lei especial&nbsp;&#8211;&nbsp;<strong>AgInt<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>REsp<\/strong><strong>&nbsp;1742902\/DF<\/strong>,&nbsp;DJe&nbsp;26\/10\/2020).<\/p>\n\n\n\n<p><strong>13)<\/strong>&nbsp;A&nbsp;S\u00famula 308\/STJ (a hipoteca firmada entre a construtora e o agente financeiro, anterior ou posterior \u00e0 celebra\u00e7\u00e3o da promessa de compra e venda, n\u00e3o tem efic\u00e1cia perante os adquirentes do im\u00f3vel) aplica-se apenas aos im\u00f3veis residenciais&nbsp;\u2013&nbsp;<strong>EDcl<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>AgInt<\/strong><strong>&nbsp;nos&nbsp;<\/strong><strong>EDcl<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>AgInt<\/strong><strong>&nbsp;nos&nbsp;<\/strong><strong>EDcl<\/strong><strong>&nbsp;nos&nbsp;<\/strong><strong>EDv<\/strong><strong>&nbsp;nos&nbsp;<\/strong><strong>EREsp<\/strong><strong>&nbsp;1352341\/PR<\/strong>,&nbsp;DJe&nbsp;07\/10\/2020).<\/p>\n\n\n\n<p><strong>14)<\/strong>&nbsp;O adquirente de unidade imobili\u00e1ria, mesmo n\u00e3o sendo o destinat\u00e1rio final do bem, poder\u00e1 encontrar abrigo na legisla\u00e7\u00e3o consumerista com base na teoria finalista mitigada se tiver agido de boa-f\u00e9 e n\u00e3o detiver conhecimentos de mercado imobili\u00e1rio nem expertise em incorpora\u00e7\u00e3o, constru\u00e7\u00e3o e venda de im\u00f3veis, sendo evidente sua vulnerabilidade&nbsp;(<strong>AgInt<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>REsp<\/strong><strong>&nbsp;1865765\/RJ<\/strong>,&nbsp;DJe&nbsp;24\/09\/2020).&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>15)<\/strong>&nbsp;Nos compromissos de compra e venda de unidades imobili\u00e1rias anteriores \u00e0 Lei n. 13.786\/2018, em que \u00e9 pleiteada a resolu\u00e7\u00e3o do contrato por iniciativa do promitente comprador de forma diversa da cl\u00e1usula penal convencionada, os juros de mora incidem a partir do tr\u00e2nsito em julgado da decis\u00e3o (<strong>REsp<\/strong><strong>&nbsp;1740911\/DF<\/strong>,&nbsp;DJe&nbsp;22\/08\/2019;&nbsp;<strong>AgInt<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>AREsp<\/strong><strong>&nbsp;1674588\/SP<\/strong>,&nbsp;DJe&nbsp;27\/08\/2020;&nbsp;<strong>AgInt no AgInt no AREsp 1397224\/SP<\/strong>, DJe 26\/10\/2020).&nbsp;<\/p><div class=\"dqqms69e6e1a3e08e4\" ><!--<a href=\"https:\/\/bit.ly\/3QdrqTZ\" target=\"_blank\">\n<img vendedor (aquele que tem a propriedade registrada no Registro de Im\u00f3veis) s\u00e3o contribuintes respons\u00e1veis pelo pagamento do IPTU,&nbsp;podendo o legislador municipal eleger quaisquer deles&nbsp;(<strong>AgInt<\/strong><strong>&nbsp;nos&nbsp;<\/strong><strong>EDcl<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>AREsp<\/strong><strong>&nbsp;1680295\/SP<\/strong>,&nbsp;DJe&nbsp;27\/08\/2020;&nbsp;<strong>AgInt no REsp: 1847964\/SP<\/strong>, DJe 06\/10\/2020).&nbsp;<\/p>\n\n\n\n<p><strong>17)<\/strong>&nbsp;A exist\u00eancia de cl\u00e1usula de irrevogabilidade e irretratabilidade, bem como do registro do compromisso de compra e venda n\u00e3o desnaturam a legitimidade do promitente vendedor pelo pagamento do IPTU incidente sobre o im\u00f3vel&nbsp;(<strong>AgInt<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>REsp<\/strong><strong>&nbsp;1831836\/SP<\/strong>,&nbsp;DJe&nbsp;31\/08\/2020).&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>18)<\/strong>&nbsp;O atraso na entrega de unidade imobili\u00e1ria na data estipulada n\u00e3o causa, por si s\u00f3, danos morais ao promitente-comprador (<strong>AgInt<\/strong><strong>&nbsp;no&nbsp;<\/strong><strong>REsp<\/strong><strong>&nbsp;1854984\/SP<\/strong>,&nbsp;DJe&nbsp;21\/09\/2020).
